Atilis Gym Gets Justice

During Covid Con thousands of small businesses were maliciously forced to close. They were assaulted by alphabet agency storm troopers.

Most owners walked away losing all. Those that resisted were arrested, jailed and fined. It’s been four years and honest citizens are still suffering prosecutorial abuse and lawfare.

The authoritarian state can harass and taunt with endless hearings, motions, and gaslighting. The tax-funds used to pummel the business owner are massive versus the meager holdings of the defendants.

This is not justice. It is ruthless, cruel and barbaric injustice. Many attorneys won’t even take these cases since they don’t want to be “marked” by the system to be blackballed on future legal contests.

Some owners stood for and spoke the truth. History has proven them 100% right and Covid tyrants 100% wrong. However, “in an era of universal deceit, telling the truth is a revolutionary act.”

Under English law in the 1600’s, it was a criminal offense (seditious libel) to publish or otherwise make statements intended to criticize or provoke dissatisfaction with the government. Truth was not a defense and, in fact, made the offense worse. English libel law applied the following maxim: “The greater the truth, the greater the libel.”

Early colonists from Europe found the concept of seditious libel incompatible with their quest for freedom. In communist countries today and in the United States you can be sued, tried and jailed for criticizing the government and its policies, though you speak the truth.

Instead of the government being contrite and repentant for its Covid lawlessness it has remained relentless at “winning” at all costs to make an example of resisters. It is analogous to the Romans use of public crucifixion to horrify onlookers into blind submission.

A recent anomaly to government brutality was the court ruling for Atilis Gym of Bellmawr, New Jersey. Owners Frank Trumbetti and Ian Smith have been cleared of the 80 charges and summonses brought against them by New Jersey for defying Covid mandates. The two were forced to pay about $269,000 in fines and court fees before the charges were finally dropped.

Smith said in a January 2021 video statement, “Governor Phil Murphy seized 100% of our assets today – $165k, all of which came from donations and apparel sales. This is done in the middle of ongoing litigation defending ourselves against these fines, our 80 charges, the revocation of our business license, and the unconstitutional health department shutdown. This was never about protection it was always about control.”

Smith wrote, “4 years ago today, we reopened Atilis Gym in direct violation of an unconstitutional order by Governor Philip Murphy to close small businesses in New Jersey. The support we received locally, nationally, and internationally for our stand is something I will be forever grateful for.”

“I am thrilled to announce that we have achieved a major victory in the long, hard fight against the State. ALL OF THE 80+ municipal citations of violations of a governor’s order, public nuisance, disturbing the peace, and operating without a license against us have been dropped by the courts WITH prejudice. This means the State has NO ability to revisit or refile these charges.”

However, for every victory against the Neros of the pandemic, thousands of businesses and owners have been bullied into financial ruin. County Supervisors chose to sacrifice their constituents on the altar of state / federal bribery, making them millions. They lack both a conscience and a backbone.

Incredibly, government officials now contend that they did not mandate a thing. “They were just offering advice that was optional.” However, if you don’t follow that “advice,” you will be destroyed.

Randy Mitchell and his Upper Cut Barber Shops are the Atilis Gym of Yuba / Sutter / Butte / Placer Counties. Their fight goes on and fines and legal costs are approaching $200,000.
